Resumen

El consumo de alcohol condiciona diferentes grados de desinhibición conductual, se reconoce internacionalmente como un factor criminógeno de primer orden y conlleva repercusiones médico-legales, agravadas si aparecen síntomas psicóticos asociados. En el presente caso, se analiza la implicación del alcohol en la génesis de la conducta delictiva, la repercusión jurídica del cuadro clínico asociado al consumo y las complicaciones médico-legales surgidas en su manejo. Se pone de relieve la necesidad de mejorar la organización de los servicios de urgencias aplicando sistemas de seguridad, tanto activos como pasivos, para evitar los comportamientos suicidas y se aborda la potencial responsabilidad de la institución. En pacientes en que se objetivan trastornos de conducta y peligrosidad social asociada al consumo, resulta de especial relevancia la actuación desde el ámbito médico-forense y jurídico para la prevención de futuras conductas antinormativas. Se analizan las ventajas que supondrían las medidas de seguridad o el tratamiento ambulatorio involuntario.

Abstract

Alcohol consumption determines different degrees of behavior disturbances, it is worldwide recognized as a first-order criminal factor and carries medico-legal repercussions, aggravated if associated with psychotic symptoms. In the present case report, the implication of alcohol in the genesis of the criminal behavior, the juridical repercussion of the clinical condition associated with the consumption and the medicolegal complications of its clinical management are analyzed. We emphasize the need to improve the organization of emergency services, as well as to implement safety measures, both active and passive, in order to prevent suicidal behaviors, addressing the potential institutional responsibility. In patients with behavior disorders and social dangerousness associated with alcohol consumption, the forensic and juridical intervention is especially relevant, in order to prevent future criminal behavior, analyzing the advantages that would result from the implementation of security measures or an assertive community treatment.
