Resumen

La valoración del estado secuelar residual relativo a los traumatismos craneoencefálicos (TCE), es por su trascendencia y dificultad, uno de los retos más importantes para el perito médico, por lo que un conocimiento exhaustivo de las circunstancias causales de la lesión, de su alcance y del estado residual del paciente, llevará junto al conocimiento del estado anterior del lesionado, a alcanzar un criterio secuelar que deberá ser consecuentemente valorado en base a los baremos aplicables en cada caso. Por su extensión, es imposible incluir los baremos más habituales, en función del marco de responsabilidades, que dan cobertura al daño causado, no obstante explicaremos los fundamentos del baremo más aplicado en la actualidad (Ley 30/95) que ampara a los accidentados de tráfico (contingente más frecuente en el origen del TCE), además de mencionar otros baremos que pueden ser usados en estos casos. Se realiza también un amplio desarrollo del tipo de secuelas que nos podemos encontrar tras un TCE y que debemos conocer lo más profundamente posible para llegar a discernir la imputabilidad de las mismas.

Assessment of the residual sequelar state related to cranioencephalic traumatism (CET) is, due to its transcendence and difficulty, one of the most important challenges for the medical expert, so that extensive knowledge of the causal circumstances of the injury, of its reach and the residual state of the patient, together with knowledge of the previous condition of the injured subject, would lead to reaching a sequelar criterion that should be consequently assessed based on the applicable standard in each case. Due to its extension, it is impossible to include the most common standards, based on the framework of responsibilities, that cover the damage caused, however we will explain the foundations of the most applied standard at present (Law 30/95) that protects traffic accident victims (most frequent contingent in the origin of CET), in addition to mentioning other standards that can be used in these cases. A wide development of the type of sequels that we can find after a CET and that we should know as completely as possible to be able to discern the imputability of them is also performed.
